These Terms of Service (“Terms”) govern your access to and use of the WIND HR website (the “Site”) and the services we provide (the “Services”). By accessing or using the Site or Services, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.
“WIND HR,” “we,” “us,” or “our” – WIND HR LLC, a Delaware company, with affiliated operations in WIND HONDURAS S. de R.L. and Mexico City.
“Site” – www.wind-hr.com and its subdomains.
“Services” – Recruitment, consulting, Employer of Record (EOR) and freelancer contract management, training, and related offerings (online or offline).
“User” – Any visitor to the Site or user of the Services.
“Client” – Any organization engaging WIND HR for Services.
“Candidate” – Any individual applying for or being considered for a role through WIND HR.
“Content” – All materials, text, data, graphics, and software available on the Site.
You must be 18 years or older (or the age of majority in your jurisdiction) to use our Site or Services.
WIND HR provides professional recruitment and HR support services.
While we strive for accuracy, we do not guarantee employment outcomes or job placement.
Unless explicitly stated in an EOR contract, WIND HR is not the employer of record for Candidates you hire.
You agree not to:
- Use the Site or Services for unlawful purposes.
- Attempt unauthorized access to any system or data.
- Disrupt or interfere with operations.
- Upload malicious code or spam.
- Misrepresent your identity or affiliation.
- Scrape or automate data without written permission.
You are responsible for keeping your information accurate and credentials secure.
By using the Services, you consent to transactional communications.
You may opt out of marketing emails at any time.
Fees and commercial terms are defined in the relevant order form or SOW.
Invoices are issued via Zoho Books with NET 7–15 terms unless agreed otherwise.
Late payments may incur reasonable fees and collection costs.
All Content on the Site is owned by WIND HR or its licensors.
You may not copy, modify, or redistribute materials without our written consent.
Any feedback or ideas you submit may be used by WIND HR royalty-free and without restriction to improve our Services.
We handle Client and Candidate information according to our Privacy Policy.
You agree not to share confidential information obtained through our Site or Services.
Our Site may contain links to third-party websites. We are not responsible for their content or policies. Use them at your own risk.
You must comply with all applicable laws (including anti-discrimination, labor, export-control, and sanctions regulations).
You remain solely responsible for your own hiring decisions and workplace compliance.
The Site and Services are provided “as is” and “as available.”
We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement.
We do not guarantee that our Site or Services will always be secure, error-free, or uninterrupted.
To the maximum extent permitted by law, WIND HR is not liable for any indirect, incidental, consequential, or punitive damages — including loss of profits, data, or goodwill.
If liability cannot be fully excluded, our aggregate liability is limited to the greater of US $100 or the fees you paid in the three months before the event giving rise to the claim.
You agree to defend and hold harmless WIND HR, its affiliates, employees, and agents against claims arising from your use of the Site or Services or your violation of these Terms or applicable law.
We may suspend or terminate access at any time, with or without notice.
Sections 8–18 survive termination.
During any active engagement and for 12 months after, neither party will solicit the other’s employees, except through public job ads.
This clause may be included in your SOW template.
We may update these Terms periodically. The latest version will always be posted here with a new effective date.
Your continued use of the Site constitutes acceptance of the changes.
These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the state or federal courts of New Castle County, Delaware.
Entire Agreement: These Terms, along with any SOW and our Privacy Policy, constitute the entire agreement.
Severability: If any clause is invalid, the rest remains in effect.
Assignment: You may not assign these Terms without our written consent.
Force Majeure: Neither party is liable for delays beyond reasonable control.
Electronic Signatures: You consent to receive notices and sign agreements electronically.
